Position Description

Responsible for Leading, directing, monitoring, and improving a group of 5-7 KM direct employee ROW Agents who work in the Western United States. Manager position will be within the Operations Support Group that provides support to the following internal customers: Operations, Project Management, and the KM Commercial Groups. The OSG provides support to all 4 KM business units: Natural Gas, Terminals, Products, and CO2/Energy Ventures.

Essential duties and responsibilities:

• Direct management of KM right of way agents responsible for company property, easement and lease acquisitions, as well as ongoing ROW duties associated with maintaining our existing pipeline easements. Also provides guidance to internal KM right of way agents directing 3rd party right of way agents.

• Ensures compliance with all company and departmental policies and procedures.

• Mentors staff members in their research, review, and analysis of land titles; identification of defects and outline curative.

• Works with internal customers closely on gauging expectations and performance of the ROW Agent group.

• Ensures the ROW Agents acquire right-of-way and other property interests, as necessary to accommodate the construction, operation, maintenance of company facilities, in such a manner to minimize litigation and makes decisions needed to complete such acquisitions.

• Supports the ROW Agents with completion of property damage settlements and loss claims associated with capital projects and day-to-day pipeline operations necessary to maintain company facilities, seeking favorable outcome on behalf of the company.

• Responsible for this group’s Book of Business by ensuring all budgetary aspects of costs associated new land negotiations and existing land obligation payments are budgeted and forecasted accurately on a monthly basis.

• Reviews and ensures accuracy of KM ROW agent’s cost estimates associated with land and right-of-way project acquisition.

• Supports customers and ROW Agents with acquisition of civil permits necessary for the construction and maintenance of company facilities.

• Reviews, prepares, analyzes, and interprets Land and Right-of-Way related agreements, deeds, easements, leases, franchise agreements, permits & licenses.

• Serves as liaison between internal departments, developers, cities, counties, etc., in support of right-of-way activities.

• Works with the internal team to resolve encroachments, damage claims, landowner complaints and inquiries at a minimal cost to company.

• Works directly with all KM Business Units to support their ROW activities.

• Works with ROW agents to ensure Land/ROW compliance of Federal, State, and local regulatory requirements on our assets.

• Plans and coordinates weekly team meetings, participates in quarterly departmental management meetings, maintains oversight of right-of-way project management, reporting and departmental training.

Works 1 on 1 with each individual ROW Agent to ensure successful performance.

• Provides safety leadership to staff members and 3rd party right of way agents.

• Attends and gains feedback from internal customer team meetings on a monthly basis.

Position Requirements

Education:

• High School diploma required. College degree a plus.

Experience / specific knowledge:

• Must have a minimum of 6-8 years’ experience in performing all aspects of land and right-of-way, with a minimum of 2 years direct experience overseeing in-house staff, or equivalent industry experience.

• Knowledgeable in all aspects of right-of-way, including project management, acquisition, title, permitting, budgeting, cost forecasting, operation, due diligence, public relations, community outreach and solid understanding of general regulatory and legal issues.

• Must be able to demonstrate past leadership skills in regards to coaching employees, holding employees accountable, and ensuring solid customer relationships.

Certifications, licenses, registrations:

• A satisfactory driving record as determined by the Company and a current, valid State driver's license are mandatory.

Competencies, skills, and abilities:

• Supervisor experience, organizational skills and the ability to prioritize tasks are essential.

• Verbal and written communication skills.

• Self-starting individual who follows directions and procedures, adheres to a work schedule and can focus on details.

• Interpersonal (people) skills.

• Must be able to understand financial impacts of decisions and courses of action, results oriented.

• Intermediate computer skills in various Microsoft Applications, Outlook, Word, Excel and PowerPoint.

Physical demands:

• Anticipated 30-40% travel.

Working conditions:

• Overtime is sometimes required and often extended work hours based upon departmental work load.

• Must be available after work hours should the need arise.

• Fast paced and fluid work environment.

• Coordination with other support functions (i.e. regulatory, outreach, engineering, operations, legal, third party contractors, construction and environmental) to ensure successful and timely completion of project objectives.

Supervisory responsibility:

• The Manager will directly supervise a staff of 5 to 7, and will provide leadership and guidance to right-of-way agents to ensure compliance with company policies and procedures as appropriate.

Preferred education, experience, certifications, competencies, skills, and abilities over the minimum requirements; not required but advantageous in this position:

• Active Senior Member of the International Right of Way Association (SR/WA).

• Knowledgeable of Intrastate and Interstate projects, with a focus on pertinent FERC requirements

• Experience with complex project permitting requirements, to include relocation projects, negotiations with municipalities on rights pertaining to franchise agreements, communication and project planning with all pertinent railroads to ensure impacts are mitigated and outages scheduled timely, as well as a vast knowledge of the encroachments processes that impact KM asset
